Intel and AMD Trade Barbs Over Lawsuit

AMD's June 27 Suit Alleges Coercion

Intel and AMD traded media blasts about the lawsuit recently initiated by AMD against Intel regarding its business practices. Intel filed a response to the lawsuit with the U.S. District Court in Delaware, the publicly stated that “it refutes AMD's claims and states that its business practices are both fair and lawful.”

Intel’s general counsel Bruce Sewell said, “Innovation, investment, customer focus and great products have led to Intel's success over the years. These are the things that have been fundamental to our decision making as we've sought to move the industry and the pace of technology forward.”

In its public response to Intel’s filing and comments, AMD called Intel’s response “not surprising considering what they are trying to hide, but the facts of illegal monopoly abuse are clear and undeniable.” The remarks were attributed to Thomas M. McCoy, AMD executive vice president, legal affairs and chief administrative officer. “Intel’s anticompetitive business practices are under intense scrutiny by governments around the world,” McCoy added.

“The Fair Trade Commission of Japan found Intel guilty of antitrust violations that harmed consumers based on direct evidence, and still Intel refuses to acknowledge wrongdoing. Intel’s illicit conduct forces customers and consumers to pay artificially higher prices and limits their ability to choose the best products available.”

The lawsuit was filed by AMD on June 27, against Intel under Section 2 of the Sherman Antitrust Act, and Sections 4 and 16 of the Clayton Act, as well as the California Business and Professions Code. The complaint addresses how Intel has maintained its x86 microprocessor market monopoly “by engaging in worldwide coercion of customers to refrain from dealing with AMD,” according to the suit.
